How Does the Louisiana Mayor’s Court Work?

Louisiana’s Mayor’s Courts have jurisdiction over violations of municipal ordinances and may impose fines, imprisonment, probation, and court costs as authorized in such ordinances. A Mayor’s Court’s jurisdiction is concurrent with the courts of record, which have such jurisdiction. A Mayor’s Court may conduct trials, issue peace bonds, warrants, subpoenas, and summons, fix bails in criminal cases, and collect utility debts within the municipality when the amount in dispute does not exceed $5,000. Mayor’s Courts exist in most municipalities, except where a City Court has been established.

The Board of Aldermen, at a mayor’s request, may appoint one or more attorneys as magistrates to preside over the Mayor’s Court in place of the Mayor. Mayor’s Courts, where an appointed magistrate serves, are often referred to as Magistrate Courts. The Mayor may also delegate certain duties of the chief of police regarding the operation of the Mayor’s Courts. Such duties include traffic citation record retention, preparation of the docket, and collection of citation fees.

Mayor’s court may be held at any instance; however, several municipalities in Louisiana establish specific dates and times that the court will be in session. According to Louisiana law, a Mayor’s court should:

• Be conducted at a regularly scheduled time and location
• Be conducted in a way that will ensure access by the parties involved in a case
• Preserve a complete and accurate record of the decisions rendered by the court
• Formally convene before consideration of the court’s business (hearing testimony from defendants or witnesses, taking evidence, rendering decisions, etc.)
• Document a lack of adequate or satisfactory evidence to support a decision to dismiss

To serve as a mayor in the Mayor’s Courts, the candidate must be an elector of the municipality. Also, the candidate must be domiciled in the municipality for at least a year, at the time of qualification.
